These Terms and Conditions set out the basis on which Waste Disposal Merton provides waste collection and disposal services to customers. By placing a booking with us, whether online, by telephone or by email, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means any individual, business, organisation or other entity that places a booking with Waste Disposal Merton for waste collection or related services.
Services means any waste removal, waste collection, loading, transportation, recycling, disposal, or related services provided by Waste Disposal Merton.
Waste means any items, materials or substances presented by the Customer for collection and disposal as part of the Services, excluding any items classified as prohibited or hazardous under these Terms and Conditions or under applicable law.
Site means the premises, property or location from which the Waste is to be collected or at which the Services are to be performed.
Waste Disposal Merton provides waste collection, removal, recycling and disposal services for domestic and commercial customers. The precise scope of the Services for each booking, including the nature and volume of Waste, service date and time window, and any special requirements, will be agreed with the Customer at the time of booking.
We may use our own vehicles, equipment and staff, or subcontract certain elements of the Services to trusted third parties. In all cases, we aim to ensure that the Services are carried out in a professional manner and in compliance with applicable waste regulations.
The Customer acknowledges that our Services are limited to the collection and removal of Waste as described and confirmed at the time of booking. We do not provide cleaning, building, demolition or repair services, nor do we accept responsibility for dismantling complex structures unless explicitly agreed in writing.
Customers may request a quotation and place a booking by telephone, email or through our online enquiry process. Any quotation provided is based on the information supplied by the Customer, including the description, approximate volume and type of Waste, the access conditions at the Site, and the requested service time.
All bookings remain subject to our confirmation. We reserve the right to refuse or cancel a booking where the information provided is incomplete, inaccurate, or where the requested Services fall outside our normal operating capacity or legal obligations.
The Customer is responsible for providing accurate and complete information at the time of booking. If on arrival the Waste is materially different in volume, weight, composition or location to that described at the time of booking, we may adjust the price, modify the Services, or decline to proceed with the collection.
The Customer must ensure that an authorised person is present at the Site at the agreed time of collection to grant access, confirm the Waste to be removed and, where applicable, sign any job documentation. If no one is present and access is not possible, we may treat this as a failed collection and apply a call-out or cancellation charge.
Charges for our Services are generally based on a combination of the volume and type of Waste, the labour time required, and the distance or accessibility of the Site. We may provide an estimated price in advance based on the Customer's description, which may be subject to adjustment upon inspection at the Site.
Unless otherwise stated, all prices are quoted in pounds sterling and are exclusive of any applicable taxes or statutory charges. Where value added tax or other charges are applicable, these will be added to the invoice and payable by the Customer in accordance with the relevant law.
Payment is due in full upon completion of the Services, unless otherwise agreed in writing prior to the collection. We accept typical forms of payment such as debit card, credit card or bank transfer. For commercial accounts, we may agree alternative payment terms, subject to credit checks and approval.
If payment is not received on the due date, we reserve the right to charge interest on the overdue amount at the statutory rate applicable to commercial debts, together with any reasonable costs incurred in recovering the outstanding sums. We may also suspend or refuse further Services until all outstanding balances are settled.
The Customer may cancel or amend a booking by contacting us during our normal business hours. We request that at least 24 hours' notice is given for any cancellation or significant change to an agreed booking.
If the Customer cancels a confirmed booking with less than 24 hours' notice, we reserve the right to charge a cancellation fee to cover our administrative expenses and any costs reasonably incurred in preparing for the Service.
If our team attends the Site at the agreed date and time and is unable to carry out the Services due to lack of access, incorrect information provided, health and safety concerns, or because the Customer no longer wishes to proceed, we may treat this as a failed visit and charge a call-out fee or a percentage of the quoted price.
We will make reasonable efforts to accommodate any request to change the date, time or scope of the Services, but such changes are subject to availability and may affect the price. We do not guarantee that rescheduled dates or specific time slots will be available.
In the event that we need to cancel or reschedule the Services due to circumstances beyond our reasonable control, such as adverse weather, vehicle breakdown, staff illness or legal restrictions, we will notify the Customer as soon as practicable and offer an alternative date or time. We shall not be liable for any indirect loss arising from such cancellation or rescheduling.
The Customer must ensure that the Site is reasonably accessible for our vehicles, equipment and staff at the agreed time of collection. This includes providing access through gates, driveways, communal areas or loading bays as applicable, and ensuring that any necessary permissions or permits are in place.
The Customer must clearly identify the Waste to be collected and ensure that it is reasonably accessible, free from obstruction and not contaminated with hazardous substances, sharp objects or other materials that may pose a risk to health and safety.
The Customer must disclose any relevant information about the Site that could affect the safe and efficient provision of the Services, such as height or weight restrictions, limited parking, restricted access hours, or any known risks or hazards.
If the Site is not safe or reasonably accessible in the opinion of our team, we may refuse to proceed with the collection or may request that the Customer takes remedial steps before we continue. Any additional time or cost arising from such issues may be chargeable.
Waste Disposal Merton operates in compliance with applicable UK waste management regulations. We hold or work with providers who hold the necessary registrations and licences for the lawful collection, transportation, recycling and disposal of waste materials.
The Customer is responsible for ensuring that the Waste presented for collection is suitable for removal as part of our standard Services. We normally accept general household waste, bulky items, furniture, non-hazardous commercial waste, garden waste and certain recyclable materials.
We do not collect or transport hazardous waste, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, oils, fuel, gas cylinders, pressurised containers, explosives, radioactive materials, paint in liquid form, or any other substance classified as hazardous under applicable legislation, unless expressly agreed in advance and in compliance with specific regulatory requirements.
If prohibited or hazardous items are discovered within the Waste after collection has commenced, we may refuse to remove them, segregate them on Site, or, if necessary, return them to the Customer. Any additional costs, charges, fines or liabilities arising as a result of the presence of such items shall be the responsibility of the Customer.
The Customer agrees not to include any items that are prohibited from disposal at conventional waste facilities, or which require specialist handling or permits, without our prior written agreement. The Customer shall indemnify us for any loss, damage, costs, penalties or claims arising from a breach of this obligation.
Responsibility for the Waste remains with the Customer until it is loaded onto our vehicle and accepted by us for transport. Once the Waste has been collected, title to the Waste and responsibility for its proper disposal passes to Waste Disposal Merton or its authorised partners, except in the case of prohibited or hazardous items which we have not agreed to accept.
We will take reasonable steps to ensure that Waste is handled, transferred and disposed of in accordance with applicable environmental and waste management regulations, including appropriate use of licensed facilities and recycling centres where feasible.
We will exercise reasonable care and skill in performing the Services. However, our liability to the Customer is limited as set out in this clause.
We shall not be liable for any indirect or consequential loss, loss of profit, loss of business, or loss of opportunity arising out of or in connection with the Services, whether in contract, tort, negligence or otherwise.
We shall not be responsible for pre-existing damage to property, fixtures, fittings, driveways, access roads or surfaces at the Site. The Customer acknowledges that heavy vehicles and equipment may cause wear or damage to certain surfaces, including but not limited to lawns, paving, kerbs or unmade ground. The Customer is responsible for advising us of any fragile or particularly vulnerable areas and for directing us to suitable access routes.
Our aggregate liability for any claim arising out of or in connection with the provision of the Services shall be limited to the total amount paid or payable by the Customer for the specific Service giving rise to the claim, except where such limitation is prohibited by law.
Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.
Waste Disposal Merton maintains insurance cover appropriate to the nature of its operations, including public liability insurance. Details of our insurance arrangements can be made available on request. The Customer remains responsible for arranging any insurance it deems necessary for its own property and interests.
We collect and process personal data necessary to manage bookings, provide Services, handle payments and meet our legal obligations. Personal information may include contact details, service addresses, billing information and records of communications.
We will handle personal data in accordance with applicable data protection laws and only retain it for as long as reasonably necessary for the purposes for which it was collected or as required by law. We will not sell personal data to third parties.
If the Customer is dissatisfied with any aspect of the Services, they should contact us as soon as possible with details of the issue. We will investigate complaints promptly and aim to reach a fair resolution, which may include a re-visit, partial refund or other appropriate remedy where justified.
Both parties agree to attempt to resolve any dispute arising under these Terms and Conditions in good faith before resorting to formal legal proceedings.
We may update or amend these Terms and Conditions from time to time to reflect changes in our Services, business practices or legal requirements. The latest version will apply to any new booking made after the date on which the updated Terms and Conditions take effect.
For existing bookings, the Terms and Conditions in force at the time the booking was confirmed will normally apply, unless a change is required by law or expressly agreed with the Customer.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted to the minimum extent necessary and the remaining provisions shall continue in full force and effect.
No failure or delay by Waste Disposal Merton in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy.
The Customer may not assign or transfer any of its rights or obligations under these Terms and Conditions without our prior written consent. We may assign or subcontract our rights and obligations provided that this does not materially affect the standard of the Services.
These Terms and Conditions, together with any written confirmation of booking, quotation or invoice issued by us, constitute the entire agreement between the parties in relation to the Services and supersede any prior discussions, correspondence or understandings.
